This memorandum will outline proper tax clearance procedures for individuals or sole proprietorships bidding on state contracts. An approved tax clearance should be obtained prior to submission to the State of Kansas, and that clearance should be included in the contract package proposal, or renewal request.
The Statutory requirements for these tax clearances are as follows:
75-3740(c) Any or all bids may be rejected, and a bid shall be rejected if it contains any material alteration or erasure. The Director of Purchasing may reject the bid of any bidder who is in arrears on taxes due the state, or who has failed to perform satisfactorily on a previous contract with the state. The Secretary of Revenue is hereby authorized to exchange such information with the Director of Purchasing as is necessary to effectuate the preceding sentence notwithstanding any other provision of law prohibiting disclosure of the contents of taxpayer records or information.
PLEASE NOTE:
- Tax Clearance requests may be denied due to incomplete information provided.
- All Tax Clearance requests must be submitted using the Kansas Department of Revenue Application for Tax Clearance (Form CM-20).
- With complete information supplied by the taxpayer bidding on a state contract, and allowing for proper research and documentation, the response time for tax clearance is 24-48 hours. Incomplete information will delay Tax Clearance, and could disqualify the taxpayer from consideration in the bidding process.
If you are unable to print the Kansas Department of Revenue Application for Tax Clearance (Form CM-20) from the website (Adobe Acrobat required), you can request a copy of the form by calling (785) 296-3199.
Tax information will only be released to the following:
- The taxpayer who signed the filed tax return
- An individual who has notarized authorization from the taxpayer to request and receive tax information (please provide a copy)
- An individual who has statutory authority or legal power of attorney to request and receive tax information. (please provide a copy)
