Alcoholic Beverage Control Employee and Volunteer Registration

Who is required to register their employees and volunteers?

All On-Premise licensees (Caterers, Class A Clubs, Class B Clubs, Drinking Establishments and Hotels), Retailers, Kansas Farm Wineries and Kansas Microbreweries must register their employees and volunteers using the ABC Employee/Volunteer Registration form (ABC-805) (Rev. 09/11).

What employees and volunteers do I need to register?

On-Premise Licensees:

Caterers, Class A Clubs, Class B Clubs, Drinking Establishments and Hotels must register all employees and volunteers who are involved in the mixing, selling, serving or dispensing of alcoholic liquor, managers and/or supervisors who are in charge of the daily operations or supervise employees who serve, mix or dispense alcoholic liquor.

Employees and volunteers who are required to be registered cannot:

  • be under the age of 18 years to serve alcoholic liquor or cereal malt beverage;
  • be under the age of 21 years to mix or dispense drinks contain alcoholic liquor or cereal malt beverage;
  • be under the age of 21 years and not supervised by the licensee or an employee who is at least 21 years of age;
  • have been convicted of a felony or of any crime involving a morals charge in Kansas, any other state or the United States, to dispense, mix, or serve alcoholic liquor or cereal malt beverage;
  • be a manufacturer, distributor or retailer;
  • be an officer, agent or employee of a manufacturer, distributor or retailer in the capacity of a person registered to mix, serve, sell or dispense alcoholic liquor; or,
  • have been convicted within the previous two years of a violation of any Kansas intoxicating liquor law.

Do Not Register Cooks, Greeters, Janitors, Security, Door Persons or Bus Persons unless they are involved in the mixing, selling, serving or dispensing of alcoholic liquor.

Retailers:

Retailers must register all employees and volunteers who sell or serve alcoholic liquor, managers, supervisors and owners.

All employees and volunteers must:

  • be 21 years of age or older;
  • not have been convicted of a felony; and,
  • cannot be employed by a licensed distributor or be the spouse of an employee of a licensed distributor.

Farm Wineries:

Kansas Farm Wineries must register all employees and volunteers who sell or serve domestic wine, managers, supervisors and owners.

No Farm Winery or Farm Winery Outlet shall:

  • employ any person under the age of 18 years in connection with the manufacture, sale or serving of any domestic wine;
  • permit any employee of the licensee who is under the age of 21 years to work on the licensed premises at any time when not under the on-premise supervision of either the licensee or an employee of the licensee who is 21 years of age or over;
  • employ any person under 21 years of age in connection with mixing or dispensing domestic wine; or
  • employ any person in connection with the manufacture or sale of domestic wine if the person has been convicted of a felony.

Microbreweries:

Kansas Microbreweries must register all employees and volunteers who sell or serve domestic beer, managers, supervisors and owners.

No microbrewery shall:

  • employ any person under the age of 18 years in connection with the manufacture, sale or serving of any domestic beer;
  • permit any employee of the licensee who is under the age of 21 years to work on the licensed premises at any time when not under the on-premises supervision of either the licensee or an employee of the licensee who is 21 years of age or over;
  • employ any person under 21 years of age in connection with dispensing domestic beer; or
  • employ any person in connection with the manufacture or sale of domestic beer if the person has been convicted of a felony.

How do I know if my employee is qualified?

You may request a Kansas Criminal History Record check from the Kansas Bureau of Investigation (KBI). These record checks are fee-based. Both the fee and extent of information released is dependent on your status and the reason for which you are requesting records.

In addition, you may also view the Kansas Registered Offender information free of charge.

When do I need to register my employees and volunteers?

Applicants Applying for a New Liquor License:

Complete and submit the ABC Employee/Volunteer Registration form (ABC-805) (Rev. 09/11), along with all of the other required forms, when you apply for a new liquor license.

Existing On-Premise Licensees, Retailers, Farm Wineries and Microbreweries:

Complete and submit the ABC Employee/Volunteer Registration form (ABC-805) (Rev. 09/11) when you:

  • renew your existing license (submit the ABC-805 with your completed ABC-800 and any other required forms)
  • hire a new employee (submit the ABC-805 within five days after the employee begins work)
  • have volunteers (submit the ABC-805 within five days after the volunteer begins work)

What do I need to know about the employee and volunteer registration process?

Under the Federal Privacy Act, disclosure of a social security number for employee or volunteer registration is voluntary. If no social security number is disclosed for each person registered with the Alcoholic Beverage Control, a state issued driver's license number or government issued identification card number must be provided.

To comply with this Act, we have modified our Employee and Volunteer Registration form. Instead of the SSN field, we now have three new columns for the licensee to enter specific information: Government Issued Identification (ID), Government Issued ID Type and Issuing Government Agency. Examples of the most common data to be entered in the three new fields have been provided below. Please note that you may use abbreviations for the Government Issued ID Type and Issuing Government Agency.
