City or County Clerk Cereal Malt Beverage (CMB) Information
Overview
Cereal Malt Beverages cannot be sold without a valid CMB License that has been issued by the city or county where the licensed premise is located. Cities and counties must verify each CMB application, collect the $25 State CMB Stamp fee for each license and affix the State CMB Stamp to the application and license.
CMB APPLICATION REQUIREMENTS
CMB Applications
Pursuant to K.S.A. 41-2702(c), CMB applications for a license shall be made upon a form prepared by the Office of the Kansas Attorney General and cannot be created or modified by the city or county.
There are two types of licenses: On-Premise consumption and Off-Premise consumption. Each license type requires a separate application, State CMB Stamp and License.

CMB License Fee Schedule:
Pursuant to K.S.A. 41-2702(d)(1) and K.S.A. 41-2702(d)(2), cities and counties may charge an annual license fee in addition to the State CMB Stamp fee. The fee schedule is:
- On-Premise CMB license fee: $25 to $200.
- Off-Premise CMB license fee: $25 to $50.
State CMB Stamp:
A State CMB stamp must be attached to each CMB license. Without this stamp, the CMB license is not valid. The State CMB Stamp fee is in addition to the license fee and is collected by the city or county clerk at the time of application. State CMB stamps do not expire.

Sales Tax Registration:
For the privilege of engaging in the business of selling tangible personal property at retail in this state, i.e. CMB products, a sales tax is levied and shall be collected and paid at the statutory rate in addition to the applicable city and/or county tax. K.S.A. 79-3603.
The sales tax that is levied shall be paid by the consumer to the retailer and it shall be the duty of each and every retailer to collect from the consumer the full amount of tax imposed then remit it to the Director of Taxation. K.S.A. 79-3604.
Retailers shall make returns to the Director of Taxation using the filing frequency established by State law. K.S.A. 79-3607.
To help ensure the applicant has registered with the Kansas Department of Revenue to collect and remit sales tax, which is then distributed to your city or county, please ask the applicant to write their Kansas Retailers' Registration Sales Tax number or Federal Employer Identification Number (FEIN) in the upper left corner of the CMB application.
If the CMB applicant has not registered their business or their additional location, you may use any of the following options to obtain the Business Tax Application (CR-16) or the Kansas Registration Schedule for Additional Business Location (CR-17):

CMB LICENSING
Once all CMB application requirements have been met and verified, the license may be issued. Qualifications for a CMB License are provided in K.S.A. 41-2703.
Processing CMB Applications
The CMB Application Checklist (ABC-304) has been created to assist you with processing applications. Some common mistakes are:
- Kansas Sales Tax number is missing
- On-Premise and Off-Premise application are on the same form
- On-Premise or Off-Premise application type not checked
Obtaining CMB Stamps:
Effective January 1, 2009, State CMB Stamps are no longer automatically mailed to you. To order State CMB Stamps, complete and submit the State CMB Stamp Order Form (ABC-303) to our office by mailing, faxing or e-mailing to the address or fax number listed on the form.
Cereal Malt Beverage Retailer Licenses
Cities and counties approve and issue the Cereal Malt Beverage Retailer licenses. These licenses must be on the license prepared by the Kansas Attorney General's office (Form B-373 82236) and cannot be created or modified by the city or county. Licenses may be obtained from the Copy Center of Topeka by calling 785-234-6613.
REPORTING YOUR CMB STAMP SALES
All cities and counties are required to file their CMB Stamp Report with the Alcoholic Beverage Control (ABC) on a quarterly basis.
FILING:
- Complete your CMB Stamp Report (ABC-301) using the instructions provided on the front of the CMB Stamp Report booklet.
- If you have issued CMB licenses for the report period, attach a copy of each application that has the red State CMB Stamp affixed and remit $25 for each application by the due date.
- If you did not sell any CMB Stamps, you are still required to file the quarterly report (ABC-301) by the due date indicating "no sales".
To ensure the correct State CMB Stamp fees are received, please keep all approved applications until your report is due. DO NOT submit applications without the CMB Stamp Report (ABC-301) and payment.
