What is an administrative citation?
Citation is a legal notice issued by the Assistant Attorney General
after reviewing the alleged violation advising the Licensee of a
liquor violation and the penalty for committing the violation. To
prevent further administrative action, the suspension, if any, must
be served and the administrative fine must be paid.
What is a Summary Order?
Summary Order is a legal notice signed by the Director of the ABC
that advises the Licensee of a tax or liquor violation and the penalty
for committing the violation. To prevent further administrative
action, the violation must be resolved, the suspension, if any,
must be served and the administrative fine, if any, must be paid.
Do I need to be represented by
an attorney?
This is your decision. You may represent yourself or you may be
represented by an attorney.

You may make your payment either by mail or in person.

Who is responsible for determining
suspension and administrative fines?
The Director of the ABC.
How does the Director determine
suspensions and administrative fines?
The administrative fines and suspensions are determined by the number
and seriousness of the offenses committed and the dates of the suspensions
are determined by the Director. The Director may deviate from the
established guidelines when mitigating or aggravating circumstances
exist.
How long do I have to pay the administrative
fine?
You must make payment within 15 days from the date the Citation
or the Summary Order was received.
If I pay the administrative fine
within 15 days, what happens then?
Once you have remitted payment within 15 days, no further action
will be taken.
What will happen if I do not pay
the administrative fine within 15 days?
You will be placed on an Indefinite Suspension and will not be allowed
to make any purchases or sales of alcoholic liquor or cereal malt
beverages until either the administrative fine has been paid or
the suspension, if any, has been served. The beginning date and
time of your Indefinite Suspension is listed in the Summary Order.
Can I request a hearing with the
Director of the ABC?
Yes. You may request a hearing with the Director; however, it must
be in writing. The request must be filed within 15 days after the
service of the Citation or the Summary Order and it must state the
reason for the hearing.
When I request a hearing with the

What happens if I am not able to
make my hearing date?
You may contact the Director of the ABC to discuss the situation
at which time the Director will make a decision as to whether a
continuance will be granted. If the Director does not grant your
continuance and you are not able to make the hearing, the hearing
will be held without your presence.
What happens if I do not appear
at my hearing?
The hearing will be held without your presence and a Default Order
will be issued.
Can I appeal the decision of the
Director of the ABC?
Yes. You may petition the Secretary of Revenue for reconsideration
of the Director's decision. The petition must be filed within 15
days after the service of the Initial/Final Order and it must state
the reason for the review.
