Math and Science Teacher Employment Credit
INCOME TAXPAYER-Effective for all taxable years beginning after December 31, 2004 and prior to January 1, 2008.
An income tax credit shall be allowed for any business firm that enters into a partnership agreement to employ a mathematics or science teacher during times that school is not in session.
QUALIFICATIONS
The Secretary of Revenue shall approve these credits IN ADVANCE
on a first-come, first-serve basis. Prior to a business firm
claiming this tax credit, the Secretary of Revenue shall require
the following: (1) a partnership agreement; (2) the salary amount
paid to each teacher during the taxable year; and (3) such further
information as the Secretary requires.
No credit shall be allowed to a business firm when the teacher employed by the firm is a household or family member of any owner, director, officer or employee of such business firm.
CREDIT AMOUNT
The credit is 25% of the amount paid during the taxable year by
such business firm to teachers as salary pursuant to the partnership
agreement or 30% of the amount paid during the taxable year by
such business firm to teachers as salary pursuant to the partnership
agreement if the teacher is teaching in a school district located
in a rural community, underserved
area or underperforming urban
area.
LIMITATION OF CREDIT
The total credit allowed shall not exceed the amount of tax imposed
under the Kansas income tax act.
The total amount of credits are limited to $500,000 in any one fiscal year and no more than $125,000 of credits shall be for business firms located in any one congressional district per year. The credit utilization of each congressional district shall be evaluated by the secretary of revenue beginning in April of each fiscal year. If the secretary determines that allocated tax credits are not being utilized in a congressional district, the tax credits may be reallocated by the secretary to one or more congressional districts for utilization before the end of the fiscal year.

must be completed and submitted with the income tax return. You
may also call the Department of Revenue voice mail system at (785)
296-4937 to request Schedule K-71. You will be asked to give your
name, address, phone number and form(s) you desire. Please allow
two weeks for delivery of your forms.

DEFINITIONS
BUSINESS FIRM
Any business entity authorized to do business in the state of Kansas
which is subject to the state income tax imposed by the provisions
of the Kansas income tax act and any individual subject to the state
income tax imposed by the provisions of the Kansas income tax act.

PARTNERSHIP AGREEMENT
An agreement entered into pursuant to subsection (f) of 2005 Senate Bill
138, Section 1. Such agreement shall contain a description of the
duties of the position the teacher shall be performing, sufficient
to establish that such position satisfies the criteria set forth
in subsection (f) of 2005 Senate Bill 138, Section 1. You

TEACHER
A person who holds a certificate to teach in Kansas with an endorsement
in the areas of mathematics, science, physics, chemistry or biology
and has entered into a partnership agreement.

RURAL COMMUNITY
The meaning ascribed thereto by K.S.A. 79-32,195, and amendments
thereto.

The meaning ascribed thereto by K.S.A. 74-32,101, and amendments
thereto.

UNDERPERFORMING URBAN AREA
An area of the state in which low academic performance by pupils
in school districts in such area as determined and specified by the
state board of education.
The State Board of Education has determined that school districts with over 10,000 students that exceed the free and reduced price lunch application percentages by the state average for the preceding school year shall be considered as underperforming urban areas.

“
Rural community means any city having a population of fewer than
15,000 located in a county that is not part of a standard metropolitan
statistical area as defined by the United States department of commerce
or its successor agency. However, any such city located in a county defined
as a standard metropolitan statistical area shall be deemed a rural community
if a substantial number of persons in such county derive their income
from agriculture and, in any county where there is only one city within
the county which has a population of more than 15,000 and which classifies
as a standard metropolitan statistical area, all other cities in that
county having a population of less than 15,000 shall be deemed a rural
community.”

“
Underserved area means a geographic area of the state in which
there is a critical shortage of teachers as determined and specified
by the state board of education. ”
The State Board of Education recommends that the entire State of Kansas be designated as underserved in the areas of mathematics and science, physics, chemistry, and biology.
